Notice of Nondiscrimination and Language Assistance
Notice of Nondiscrimination and Language Assistance
Managed Mental Health complies with applicable federal civil rights laws and does not discriminate on the basis of race, color, national origin, sex, age, or disability.
DRAFT — not yet adopted. Please do not rely on this document.
This page is a draft prepared by Managed Mental Health's website consultant, Intuitive Context Consulting, for review by Managed Mental Health's own attorney. Intuitive Context Consulting is not a law firm, and this draft is not legal advice. It has not been reviewed, revised, or adopted by Managed Mental Health.
Nothing on this page creates any commitment, and nothing on this page should be relied on, until an attorney has completed and approved it and Managed Mental Health has formally adopted it. If you need help right now, please call our Hialeah office at (786) 233-6721 or our Plantation office at (954) 666-5942.
Wherever this draft says [TO BE CONFIRMED BY COUNSEL], a specific fact about how Managed Mental Health operates has not been confirmed, and it has been left blank rather than guessed.
Why this notice is required
Section 1557 of the Affordable Care Act prohibits discrimination in health programs and activities that receive federal financial assistance. Because Managed Mental Health participates in Medicare and Medicaid, it is subject to that law and to the U.S. Department of Health and Human Services regulation implementing it (45 CFR Part 92).
That regulation requires two separate notices — a notice of nondiscrimination (45 CFR § 92.10) and a notice of the availability of free language assistance services and auxiliary aids and services (45 CFR § 92.11) — and requires both to be posted at a conspicuous location on the practice's website. This page carries both.
Our nondiscrimination commitment
Managed Mental Health complies with applicable federal civil rights laws and does not discriminate, exclude people, or treat them differently on the basis of race, color, national origin (including limited English proficiency and primary language), sex, age, or disability.
This applies to every part of our practice — scheduling an appointment, being accepted as a patient, the care you receive from our therapists and psychiatric providers, telehealth visits, and billing.
[TO BE CONFIRMED BY COUNSEL — SIGNIFICANT: how to state the scope of "sex" in the paragraph above. The 2024 rule's provisions expanding Title IX's definition of sex discrimination to include gender-identity discrimination — including 45 CFR § 92.10(a)(1)(i), the very element this paragraph implements — were vacated in Tennessee v. Kennedy (S.D. Miss., final judgment October 22, 2025), and HHS published a notice of vacatur on June 2, 2026 stating that it cannot and will not enforce them to that extent. The rest of the rule, including the requirement to publish this notice, expressly remains in force. This draft therefore lists the statutory bases plainly and takes no position on that question. Counsel must decide what this practice says, bearing in mind that non-enforcement of a vacated regulatory expansion is not a holding that such discrimination is lawful, and that other sources of obligation — Title VII for employment, state and local law, payor contracts, and licensing-board ethics rules — are not affected by that vacatur and may independently govern. Counsel should re-confirm the litigation posture at adoption; an appeal or superseding rule changes this answer.]
Free services to help you communicate with us
Managed Mental Health provides the following free of charge to people who need them. You will never be billed for any of these, and you are never expected to bring your own interpreter.
- Free language assistance services to people whose primary language is not English, including qualified interpreters and information written in other languages
- Free aids and services to people with disabilities to help them communicate effectively with us, including qualified sign language interpreters
- Written information in other formats, such as large print, audio, accessible electronic formats, and other formats
- Reasonable modifications to our policies and procedures when needed to give a person with a disability equal access to our care
How to ask for these services
If you need any of the services listed above, please tell us — by phone at our Hialeah office, (786) 233-6721, or our Plantation office, (954) 666-5942, or by email at [email protected]. Please ask as far ahead of your appointment as you can, so we have time to arrange an interpreter, but tell us whenever you realize you need help and we will do our best.
[TO BE CONFIRMED BY COUNSEL: how the practice actually delivers these services, so this section describes something real. Specifically: which interpretation vendor or language line the practice uses and whether it is available for same-day and telehealth visits; how sign language interpreters are arranged and with how much notice; who at the practice is responsible for arranging them; and how a request made outside business hours is handled. A notice that promises free interpretation the practice has not contracted for is a worse exposure than no notice, because it is both an unmet civil-rights obligation and a published misrepresentation.]

About the notices above
[TO BE CONFIRMED BY COUNSEL — the choice of the fifteen languages. Research finding, not a gap: OCR has NEVER published a top-15 list keyed to § 92.11. The only state-by-state list it ever issued was released August 2016 under the PRIOR rule's tagline provision (§ 92.8(d)(1)-(2)), and it was withdrawn from hhs.gov before the 2024 rule published and never replaced. Intuitive Context retrieved that withdrawn document from the Internet Archive on 2026-07-29 and read the Florida rows directly. In OCR's stated rank order they are: 1 Spanish; 2 French Creole (Haitian Creole); 3 Vietnamese; 4 Portuguese; 5 Chinese; 6 French; 7 Tagalog; 8 Russian; 9 Arabic; 10 Italian; 11 German; 12 Korean; 13 Polish; 14 Gujarati; 15 Thai. TREAT THIS AS A STARTING POINT, NOT AS THE ANSWER: the underlying data is the 2014 American Community Survey five-year estimates, now more than a decade old; the 2024 rule grounds § 92.11 in a newer dataset; and Florida's ranks 10 through 15 are separated by only a few thousand speakers each, close enough that current data could reorder or replace them. OCR's own guidance stated that entities are not required to use its list and may rely on another source with a reasonable basis — so counsel should either adopt this list with that reasoning documented, or derive a current list, and should record which was chosen and why.]
[TO BE CONFIRMED BY COUNSEL: the telephone numbers in the notices. Each notice carries both office numbers, and gives 711 where OCR's template expects a dedicated TTY line. 711 is the FCC-mandated nationwide relay number and reaches relay for any caller in the United States, so it is accurate whether or not this practice has its own TTY equipment — but counsel should confirm it is what the practice wants published, and whether a single number would serve patients better than two.]
[TO BE CONFIRMED BY COUNSEL — two known imperfections, disclosed rather than quietly corrected. (1) The Italian notice reads "Chiama l'786-233-6721". OCR's template elides the article before its own placeholder because "uno" begins with a vowel sound; with a real number Italian would take "il". That artifact is introduced by inserting the number, and correcting it means editing the grammar of a translated legal notice, which is precisely what this build refuses to do without a qualified translator. (2) OCR's own Arabic file omits the "TTY:" label that every other language carries, so an Arabic reader sees a second number in parentheses with nothing explaining it. Both are recorded, with four other source-document quirks preserved verbatim, in src/content/legal-source/ocr-92-11-notices.json.]
[TO BE CONFIRMED BY COUNSEL: Chinese is published here in both Traditional and Simplified script, which is one language on Florida's list and two entries to read. OCR's 2016 Florida list used Traditional Chinese. Publishing both costs nothing and serves more readers, but counsel may prefer to name one.]
[TO BE CONFIRMED BY COUNSEL: § 92.11(b) also requires this notice to be provided in alternate formats for people with disabilities who need auxiliary aids to receive it — large print, braille, audio, or accessible electronic formats. A web page is one format. Counsel should confirm how the practice supplies the others on request, and who is responsible.]
[TO BE CONFIRMED BY COUNSEL: § 92.11(c)(5) requires this availability notice to be included in a list of specific patient-facing communications — application and intake forms, consent forms, complaint forms, billing and collections materials, notices of denial or termination, discharge papers, and patient handbooks. Publishing it on this page and in our Notice of Privacy Practices covers § 92.11(c)(5)(i) and (ii); it does not cover the rest. Counsel should decide how the notice is embedded in each remaining document and who owns keeping them in sync.]
If you believe we have discriminated against you
If you believe that Managed Mental Health has failed to provide any of the services described above, or has discriminated against you on the basis of race, color, national origin, sex, age, or disability, you may raise it with us directly, and you may also file a civil rights complaint with the U.S. Department of Health and Human Services. Filing a complaint will not affect your care, and we will not retaliate against you for filing one.
[TO BE CONFIRMED BY COUNSEL: whether Managed Mental Health must designate a Section 1557 Coordinator and adopt a written grievance procedure, and if so, that person's name or title and contact information, and how a patient files an internal grievance. Under the 2024 rule these two obligations (45 CFR §§ 92.7 and 92.8) apply to covered entities with 15 OR MORE EMPLOYEES; the two notices on this page apply regardless of size. The practice's employee headcount is an open question already being tracked for a different reason — it also decides the Section 504 website-accessibility deadline stated in our Accessibility Statement (docs/OUTSTANDING-ITEMS.md O9 / L11). One answer from the client resolves both. If the practice has 15 or more employees, the Coordinator's contact details and the grievance procedure are REQUIRED CONTENT of this notice under § 92.10(b) and it cannot be published without them.]
How to file a complaint with the federal government
You can file a civil rights complaint with the U.S. Department of Health and Human Services, Office for Civil Rights, electronically through the Office for Civil Rights Complaint Portal at ocrportal.hhs.gov, or by mail or phone at: U.S. Department of Health and Human Services, 200 Independence Avenue, S.W., Washington, D.C. 20201; telephone (800) 368-1019; TDD (800) 537-7697. Complaint forms are available at hhs.gov.
You may also contact us first at [email protected], or by phone at (786) 233-6721 (Hialeah) or (954) 666-5942 (Plantation). You do not have to contact us before filing with the Office for Civil Rights.
This notice must also be posted in our offices
[TO BE CONFIRMED BY COUNSEL: the obligations that publishing this web page does NOT satisfy. Under 45 CFR § 92.10, this notice must also be provided on an annual basis to patients and applicants, provided upon request, and posted in a clear and prominent physical location at both the Hialeah and Plantation offices in no smaller than 20-point sans serif font, where people seeking care can reasonably be expected to see it. Section 92.11's notice of availability carries its own placement requirements, including in specified patient communications. Counsel should confirm who at the practice owns the annual distribution, the physical postings at both offices, and the inclusion of the availability notice in patient-facing communications. Note that both compliance deadlines have already passed — § 92.10 by November 2, 2024 and § 92.11 by July 5, 2025 — so this should be treated as remediating an existing gap rather than preparing for a future one.]
Effective date
[TO BE CONFIRMED BY COUNSEL: the effective date of this notice, to be set when counsel approves the final version and Managed Mental Health formally adopts it.]
